SSA Appeal Deadlines

A denial does not have to be the end of your claim. Start by identifying your notice, your next appeal step, and the time available to respond.

This guide explains common SSDI and SSI disability appeal deadlines. It is general information, not a calculation of your individual deadline. Special procedures, including some cases returned by a federal court, can have different time limits. Check the appeal instructions in your notice. SSA time-limit guidance.

The next step depends on which decision you received. These are the usual filing periods—not estimates of how long SSA or a court will take to decide an appeal.

When Does The Clock Start?

For ordinary SSA administrative appeals, the 60-day period starts the day after receipt. SSA generally presumes that you received the notice five days after its date, unless you show that it arrived later. The five days are a receipt presumption—not a universal extra extension that applies to every deadline. Keep the notice and envelope, and record when it actually arrived. For SSA administrative appeals, if the last day falls on a Saturday, Sunday, legal holiday, or another qualifying federal non-workday, SSA extends the period to the next full workday. Medical cessation is different from an initial application denial.

If SSA says your disability has ended, the deadline to ask for continued payments can be much shorter than the ordinary deadline to appeal.

For an SSDI medical-cessation determination, you generally must request both reconsideration and continued benefits no later than 10 days after receiving the cessation notice. If reconsideration is unfavorable, another timely request for a hearing and continued benefits is needed at that stage. SSA explains the election in a separate statement of choice. For an SSI medical cessation, the regulations likewise require a timely appeal and a written election of continued benefits within 10 days after receipt of the relevant notice. A separate election is required at each appeal level covered by the rule. Do not assume that filing a standard appeal automatically elects payment continuation. Late continuation requests may be accepted if SSA finds good cause. If the final outcome is unfavorable, continued benefits can create an overpayment and repayment may be required; waiver rules may apply. What If You Missed The Appeal Deadline?

Act promptly. For reconsideration, a hearing, or Appeals Council review, you can ask in writing for more time and explain why the appeal was late. SSA decides whether there is good cause; approval is not automatic. Follow the instructions for the particular appeal level. SSA considers what prevented timely filing, whether its actions misled you, and relevant physical, mental, educational, or language limitations. Examples can include a serious illness that prevented contact, a death or serious illness in the immediate family, or not receiving the decision notice. The Appeals Council may also extend the time to file a civil action on a showing of good cause. Do not assume an extension has been granted or that contacting a law firm pauses a filing period. Federal-court timing rule.

Your Next Steps

  1. Identify the notice. Is it an initial denial, reconsideration decision, hearing decision, Appeals Council notice, or medical-cessation notice?
  2. Keep a record of receipt. Save the full notice, envelope, and the date it reached you.
  3. Check both appeal and payment-continuation instructions. These can require separate requests with different deadlines.
  4. Follow the filing instructions and keep confirmation. Retain copies and proof of submission. Ask promptly if you are unsure whether SSA received your request.
  5. Seek help early. Share the notice date and appeal stage when you contact a representative. Do not put Social Security numbers or medical records in our general website form.

Common Deadline Questions

Is the deadline always 60 days from the date printed on the letter?

No. The ordinary appeal period is tied to receipt, with SSA’s five-day presumption generally used unless later receipt is shown. Shorter continuation windows and special procedures can apply. Review the receipt rules above and your own notice.

Does asking Glassman for help stop the deadline?

Can I still ask to appeal if I am late?

You can request an extension and explain the delay. SSA must determine whether you have good cause. Read the late-appeal guidance above; do not assume a late request will be accepted.
